Federalna reforma: Zadovoljavanje potreba i zaštita prava svih građana

 

Prije više od godinu dana, počeo sam govoriti o potrebi za reformom Federacije kako bi ona postala funkcionalnija, efikasnija i manje birokratska. Apelovao sam na pojedince i lidere u civilnom društvu, akademskoj zajednici, medijima, političkim strankama, institucijama vlasti i međunarodnoj zajednici da počnu govoriti o mogućim načinima reforme Federacije. Od tada sam imao brojne, opširne razgovore sa građanima koji predstavljaju sve narode u Federaciji. Neke stvari koje sam čuo od njih bile su pozitivne, a neke negativne. Ali u zemlji u kojoj se kompromis teško postiže (ukoliko se to uopšte desi), bio sam prijatno iznenađen da postoji skoro jednoglasna podrška ideji reforme. Građani Federacije vjeruju da se Federacija može i treba promijeniti nabolje.

Iako mi vjerujemo da je reforma Federacije nešto što je, očigledno, neophodno, ja sam uvijek naglašavao da lokalne vlasti, pravni stručnjaci, lideri civilnog društva i građani trebaju biti ti koji će preuzeti odgovornost za vođenje i provođenje reformi. Neki kažu da jedino pristup “odozgo nadolje” iz međunarodne zajednice može dovesti do promjene, te ideju o reformi koju bi vodili građani čak nazivaju naivnom. A ja mislim da je istina upravo suprotna. Prijašnja nastojanja da se reforma provede fokusirala su se na podsticanje političara i lidera u vlasti da sami postignu kompromis. Nažalost, ta nastojanja su doživjela neuspjeh. 

Zato smo mi otpočeli razgovore o reformi Federacije na drugačiji način: primjenom principa “odozdo nagore”, da bismo podstakli inkluzivnu diskusiju i proces. I građani reaguju na to. Neki šalju opsežne planove, dok drugi jednostavno nude podršku. U televizijskim emisijama političkog sadržaja vodi se debata o vrijednostima i političkim mogućnostima različitih ideja za reformu. Političari sve više uviđaju da ova reforma, jednostavno, ne može biti još jedna stavka na agendi koju će ostaviti za narednu godinu. Jasno je da je građanima stalo da poboljšaju Federaciju i da žele da budu dijelom procesa unapređenja funkcionisanja vlasti u Federaciji.   

Do sada je naš cilj bio rad na poticanju promišljene diskusije o potrebi za reformama i o tome kakve bi te potencijalne reforme mogle biti. A sada je vrijeme da ovu diskusiju podignemo na novi nivo. Kao što sam govorio posljednjih nekoliko mjeseci, mi radimo sa ostalim članovima međunarodne zajednice na organiziranju radne konferencije na kojoj bi se okupili relevantni stručnjaci iz civilnog društva u cilju identificiranja predloženih promjena ustavne strukture Federacije i razgovora o njima. 

 Moja ambasada je okupila grupu poznatih i uvaženih pravnika i stručnjaka kako bi pomogla da ovaj proces napreduje i da se artikuliraju konkretne opcije za reformu. Ova će grupa pregledati sve do sada pristigle prijedloge i preporuke i pažljivo razmotriti sve opcije za poboljšanje funkcionalnosti, efikasnosti i isplativosti Federacije. Ona će djelovati neovisno, te će organizovati sastanke i razgovore sa različitim pojedincima i grupama, uključujući odgovarajuće zvaničnike u vlasti čiji je cilj također poboljšanje stanja u Federaciji. Zamolio sam ovu ekspertnu grupu da se fokusira na prijedloge koji su politički pragmatični i koji bi mogli dobiti široku podršku svih građana. Isto tako, zamolio sam ih da ne uzimaju u razmatranje reforme koje bi dalje dijelile BiH.

Mi se nadamo da će ekspertna grupa prezentirati svoje nalaze kao osnovu za diskusiju na konferenciji i da će raditi sa zainteresiranim građanima i organizacijama civilnog društva u cilju poboljšanja ovih prijedloga, s krajnjim ciljem izrade promišljenih i politički pragmatičnih prijedloga za ustavne reforme koji će ovoga ljeta biti prezentirani liderima u vlasti i političkim liderima. Mi pozdravljamo sve oblike učešća u vezi sa potrebnim ustavnim reformama u Federaciji kao dio ovoga procesa.

Moji motivi za insistiranje na reformi federalnog ustava su jednostavni. Federacija je isuviše komplicirana, isuviše skupa i ne služi najboljim interesima građana. Ovo je diskusija o funkcionalnosti Federacije i efikasnosti Vlade FBiH, a ne samo diskusija o kartama ili teritorijalnom prestruktuiranju. Ovu diskusiju ne bi trebalo zloupotrijebiti za poticanje strahova ili zabrinutosti za nacionalne interese. Ovdje se ne bi trebalo govoriti o “američkom planu” jer – kao što sam rekao nebrojeno puta do sada – ne postoji nikakav američki prijedlog. Ono što mi želimo jeste podržati građane Bosne i Hercegovine u izražavanju njihovih mišljenja o potrebnim reformama, te angažirati stručnjake i pripadnike civilnog društva u Federaciji da stvore sopstvenu viziju bolje, funkcionalnije Federacije. Zahvaljujem grupi eksperata koji su prihvatili da rade kreativno, na najbolji mogući način, u interesu njihovih sugrađana. Naš cilj je zajednički – Federacija koja na bolji način zadovoljava potrebe svih građana i štiti njihova prava.

Federation Reform: Meeting the Needs and Protecting the Rights of All Citizens

Over a year ago I began talking about the need to reform the Federation to make it more functional, more efficient and less bureaucratic.  I urged individuals and leaders from civil society, academia, media, political parties, government institutions, and the international community to start talking about how the Federation could be reformed.  Since then I have had numerous, wide-ranging conversations with citizens representing all the peoples of the Federation.  Some of the feedback has been positive and some negative.  But in a country where compromise comes hard (if at all), I have been pleasantly surprised that there is almost unanimous support for the idea of reform.  Citizens of the Federation believe the Federation can and should change for the better.

While we believe Federation reform is clearly a necessity, I have always maintained that local authorities, legal experts, civil society leaders, and citizens need to take responsibility and leadership for making reform happen.  Some have said only a "top down" approach from the international community will make change possible, even calling the idea of citizen-led reform naive.  I think just the opposite is true.  Past reform efforts have focused on urging politicians and government leaders to compromise on their own.  Unfortunately, these past efforts did not succeed. 

That's why we began this discussion on Federation reform in a different way: with a "bottom up" approach, to spur an inclusive conversation and process.  And citizens are responding.  Some send lengthy plans while others just simply offer support.  Public affairs programs debate the merits and political possibilities of various reform ideas.  And politicians increasingly see that reform cannot simply be another agenda item to put off until next year.  It is clear that people care about improving the Federation and want to be a part of the process to improve governance in the Federation.

To date, our goal has been working to spur a thoughtful discussion about the need for reform and what potential reforms could look like.  It is now time to take this conversation to a new level.  As I have said over the past few months, we are working with other members of the international community to organize a working-level conference to bring together relevant experts within civil society to identify and discuss proposed changes to the constitutional structure in the Federation. 

To help move this process forward and to articulate concrete options for reform, my embassy has brought together a group of well known, respected, and thoughtful lawyers and experts.  This group will look at suggestions and recommendations received thus far and will carefully consider all options to improve the functionality, efficiency, and cost effectiveness of the Federation.  They will act independently, and they will talk with and meet with individuals and groups, including appropriate government officials, who share the goal of improving the Federation.  I have asked the expert group to focus on proposals that are politically pragmatic and could gain the broad support of all citizens.  Likewise, I have asked them not to consider reforms that would further divide BiH.

Our hope is for the expert group to present their findings as the basis for a discussion at the conference and to work with concerned citizens and civil society organizations to hone these suggestions, with the end goal of developing thoughtful and politically pragmatic proposals for constitutional reforms to present to government and political leaders this summer.  As part of this process, we welcome all forms of input about needed Constitutional reforms in the Federation.

My motives for pushing for reform of the Federation Constitution are simple.  The Federation is too complicated, too expensive and does not serve the best interests of the citizens.  This is a conversation about functionality of the Federation and responsiveness of the Federation Government, not just a conversation about maps or territorial reorganization.  It should not be a discussion that is misused to stoke nationalist fears or worries.  It should not be about a "U.S. plan” -- as I have said many times, there is no U.S. proposal.  Rather we want to support the citizens of Bosnia and Herzegovina in voicing their opinions on needed reforms and to engage experts and members of civil society in the Federation to craft their own vision of a better, more functional Federation.  I thank the group of experts for agreeing to work creatively in the best interests of their fellow citizens.  We share with them a common goal -- a Federation which better meets the needs and protects the rights of all of its citizens.
